CORINNA TOWNSHIP MEETING MINUTES

7 P.M., Town Hall Unapproved

Present: Sandra Ransom, Dick Naaktgeboren, Dean Flygare, Charles Marohn, and Bryon Schoeffer and Town Board: Chairman, John Dearing, Supervisor Bill Lieb, Supervisor

Bill Lieb and Clerk/Treasurer Vi Novotne.

Meeting opened with the Pledge of Allegiance.

With motion by Bill Lieb, second by Ken Jude, the minutes of the October 4 Town Board Meeting were approved as printed.

With motion by Ken Jude, second by Bill Lieb, the Agenda was approved with the addition of items: Coordination of Land Use Plan with other Townships and Hansford Junk Violation at 6400 102nd Street NW.

Requests to be on the Agenda:

1. Andrew and Cheri Fink, cabin at 10501 Kimball Avenue NW, Windy Cliff Woods, Lots 11, 12, and 13 , PID 206-063-000110.(Absent)Survey and completed P&Z application was available. Request to remodel cabin and make front entry and living room wheelchair accessible and add second story in back of cabin. Ken Jude presented motion to allow request for a 4’ extension on a lakeside portion of the home that is less than on another portion of existing home. The existing home is 45’ from the ordinary highwater mark of the lake. Sewer and well must be conforming. Bill Lieb, second Motion approved.

2, Harvey Dahl, 11420 103rd Street NW.(absent) Discuss road project.

3. Charles Marohn, Professional Engineer and Planner, Community Growth Institute. Planning and Zoning Presentation. Ken Jude stated that townships need to take on responsibilities and if townships do not, the townships may loose the right for some of the responsibilities. Ken continued that he asked Community Growth Institute to present how they could assist a township in Planning and Zoning. Chuck Marohn stated that they now assist 30 cities, townships and counties in small rural areas like Corinna with a population of 2500. In City of Emily they provided assistance with building permits and zoning ordinance and served as planning department. In Todd County the institute covered feedlot, sewer and housing permits, and plot guidance. In a township, like Pequot Township of 1100 population, served them thru the entire process as a county furnishes now and helped the decision process as what best areas for the township to serve and the land use plan process. Cities and counties have authority mandated. Townships can exercise authority but must follow a process. Mr. Marohn did not advocate township planning and zoning or speak against the township responsibility. Mr. Marohn stated that City cannot zone township land and annexation is a process that is to be negotiated with the city.

Mr. Marohn continued that their business is to provide the service which is cost effective for a township with a population of 2500 people. Township would need a Planning Commission, a technical staff which could be a Zoning Administrator or Clerk, and a process to alert people of the change of service to locally. Ken stated that county permit fees are in excess of $70,000 a year and Corinna has an average of 30 permits or more per month Bill Lieb added that as he is on Board of Adjustment, he recognizes the need for legal accurate descriptions. Ken questioned the professional service necessary for sewer designs and inspections.. Mr. Marohn stated that from a list of local contractors qualified to be an inspector, one or two would be contracted by township. Mr. Marohn added that a sewer designer follows guidelines and must meet standards. Sometimes the county can become an autocratic system. The Community Growth Institute has never had a case to court and realizes the importance of being factual specific for a conclusion. Township must have good planning and can have authority to assume planning and zoning responsibilities. Townships take on authority with a vote of town board or by a entire township referendum vote Dean Flygare commented that he has no issues with the county’s present handling of the process and that of the many types of sewer systems now available one can fit the land owner’s need. Dick Naaktgeboren who served on the 1998 Corinna’s Updated Land Use Plan commented on that process. Sandy Ransom commented that if township took on Planning and Zoning that it should be in the form of a referendum voted on by all property owners in township. Ken Jude concluded that townships are known only for their care of roads and townships need to take on much more responsibility.

Other Items:

1. 103rd Street Reconstruction. Kjolhaug Environmental Services forwarded a copy of letter to Board of Soil and Water Resources regarding 103rd Street Wetland Impacts, Minutes of the Wetland Conservation Act Technical Evaluation Panel Meeting of September 16, 2005 and a copy of the signed application for withdrawal of wetland credits from Minnesota Wetland Bank. MPCA acknowledged completed storm water application and forwarded Notice of Storm Water Permit Coverage. The board discussed the possible costs for the wetland exchange.

2. Isaak Avenue Road Improvement. Buffalo Bituminous will receive payment for approved quantities. Payment for work that has not been done and charges from Mathiewitz Construction, the dirt sub-contractor of Buffalo Bituminous, requesting payment covering extra charges for importing and exporting excavated dirt as they moved the dirt from the Isaak Project to the 80th Street Project has had payment withheld. Ken Jude felt some legal pressure should be exerted and that township should notify bonding company that the work has not been completed

3. Town Hall Construction. Bids are accepted until 4 p.m., October 20, 2005 at the clerk’s office. Bid opening is at 7 p.m. at the town hall. With motion by Ken Jude, second by Bill Lieb, the board approved the Award or Reject of Bids on Tuesday, October 25, 7 p.m. at the town hall.

4. Trace Development Petition for Annexation of 80 acres of land to the City of Annandale. Dick Baker forwarded a prepared resolution from City of Annandale covering a Joint Resolution for Orderly Annexation between Corinna Township and the City of Annandale. The board had no opposition to this petition however, at this time the board cannot enter into any agreement with the City of Annandale until the City provides proof that utilities such as sewer and water are being provided to this land. Clerk was instructed to prepare a letter with this information signed by Chairman to the City of Annandale and a copy to Trace Development. Ken Jude suggested that a special meeting with the City of Annandale should be arranged to discuss and make annexation requirement decisions.

5. City of Annandale, letter 10/6/05 acknowledged township letter of September 231, 2005. Land Use Plan Consultant Mike Darrow forwarded an invitation and agenda for the October 24, 2005 City Council Meeting where the Planning Commission will submit recommendation on the Plan to the City Council. The Town Board does not plan to attend the October 24 meeting.

6. October Corinna Newsletter: The Newsletter informed all of the Corinna Township property owners of the City of Annandale’s Proposed Land Use Plan and a map showed the area of future planned annexation. Property owners were encouraged to attend and voice their concerns at the City Council Meeting, October 24. Copies of the newsletter were also mailed to Maple Lake Messenger; Annandale Advocate; the City of Annandale Council and Commissions; Tom Salkowski, Director of Wright County Planning and Zoning and the County Commissioners.

With motion by Ken Jude, John Dearing, second, the board approved payment for newsletter printing from Royal Print Group, Invoice #10753, for $1,171.50

7. Wright Recycling: Wright Recyling letter of 10/5/05, stated that due to significant petroleum price increases, monthly service price will be increased by 5%. With motion by Bill Lieb, second by Ken Jude, the board approved the 5% increase. Ken Jude stated that Wright County has a Recycling Fund, S.C.O.R., which has $350,000 specified for recycling programs. The board asked that a letter be written to Dick Norman, Wright County Coordinator, requesting financial assistance for our curbside recycling program.

8. Sugar Lake Association forwarded copy of letter, 10/10/05 to Tom Salkowski, Wright County Planning and Zoning Administrator. Board reviewed letter that stated that in their opinion now is not the time to rezone and allow the requested classifications for the Marianne Peterson and Raymond Lehn Property, on Sugar and Indian Lakes The board’s comments were that this request did not change the 1998 Corinna Land Use Plan and what Corinna Town Board approved was consistent with this land use plan . .

9. Greg Cooley, Dept of Transportation, request for Quit Claim Deed (telephone call 10/122/05. Request that township execute quiteclaim deeds for the Felten property to release the recorded easement interest that the township has as custodians of the cemetery immediately west of their property. Mr. Cooley stated this quiteclaim deed will assist in acquiring clean title of the right of way. The State plans to construct an entrance to the cemetery from the highway as a part of the project. A township resolution and a certificate of resolution are to be also forwarded. As the board did not wish to provide these documents until the township has access to the cemetery, John Dearing offered to discuss the quiteclaim details with Greg Cooley of DOT. This request will be continued at the next township meeting, November 1.

10. Arns/Erickson Quiet Title Action, John T. Peterson, Attorney. Parcel described as Lot 35, Clearwater Beach. With moption by Ken Jude, John Dearing second, the Board acknowledged receipt of summons and complaint.

11. Wright County Township Officer’s Association Quarterly Meeting, October 13, 200 5.

Bill Lieb reported that three more counties have been added to Metro Area. Several townships will hold special elections in November. Low attendance at the meeting.

12. Building Permits: (8/30-10/5/05 (30 permits) 10-Septic Systems; 2-pole buildings; 1-shed; 1-deck; 4-additions; 5-garages; 1-portocol; 3-new homes; 1-storage building; 1-Corinna Town Hall; and 1-land alteration.

13. Township Coordination Plans: Ken Jude reported that Linden Township Board hosted a special meeting for local town board members to discuss how each township could cooperate with sewer improvement planning.. Ken added that townships need to make educated decisions and take control and sewer planning could be one of the areas.

10/18/05 Neighbor called that property has become more filled with junk..

Fire pit has personal items, couch, tires, etc. Raccoon digs into this garbage and some of the garbage ends up in her yard. The property has been referred to Wright County Sheriff Department. Clerk will check if owner has been given a court action date.

As there was no further business, Bill Lieb presented motion to adjourn, and second by Ken Jude. Meeting adjourned at 10:30 p.m.
