CORINNA TOWNSHIP MEETING MINUTES
Tuesday, October 16, 2007
7 p.m., Town Hall Unapproved
Present: Charlotte Quiggle, Terri Malachek, Jim Miller, Dean Flygare and Town Board: Chairman Alan Jude, Supervisor John Dearing, Supervisor Dick Naaktgeboren and Clerk/Treasurer Vi Novotne.
The meeting was opened at 7 p.m. with the Pledge of Allegiance.
With motion by Dick Naaktgeboren and second by John Dearing, the minutes of the October 2, 2007 meeting were approved as presented.
With motion by John Dearing, second by Dick Naaktgegoren, the agenda for this meeting was approved with the following additions: Requests: Bob Gruys, Ron Yanish, Jim Miller, Dean Flygare. Other Business: Signatures for Resolution 2007-03, Ordinance 2007-01 and Policy No. 07-01.
Copies of the previous meeting minutes, this meeting’s agenda were available for those attending this meeting.
Requests to be on the Agenda:
1. Bob Gruys: (Absent) Request for Conditional Use Permit for a home business at 9711 Ireland Ave NW. No discussion.
2. Jim
Miller: Property address of 11859 89th
Street NW (PID 206-048-000080).
Request variance for septic system setback from road. Discussion. With motion by Dick Naaktgeboren, second by John Dearing, the town board approved a variance for the septic system to be 7’ from the road right of way and a 10’ side lot.
3 Ron Yanish: (Absent) Property address of 11487 89th Street NW (PID 206-062-000201). Request for variances for the addition of a 26x12 screened porch to home. Town Board made a site visit, October 11, 2007. As screened porch, approximately 12x26, is at present time covered by house and cement patio, no extra lot coverage is necessary. The porch will be not closer to the lake than existing cabin and patio. Both neighbors, on east side and west side, have a boat house and a home that are at least 25’ closer to the lake.
New sewer is encouraged by township and the sewer will be allowed 3’ from west property line. West neighbor has a cement driveway 3’ from property line. This placement should be a good fit.
Mr. Yanish’s cabin is 8’9” and 9’.6’ to west property line. West neighbor’s new home is 4’4” to property line and retaining wall is less than one foot from lot line.
With motion by Dick Naaktgebhoren, seconded by John Dearing, the town board granted approval for a permit to Ron Yanish.
4. Dean Flygare, 9850 91st Street NW. Request to pave 91st Street. Dean Flygare asked if the previous petition for paving is valid, as with the reconstruction of Highway 24 nearly complete and a new street has been built, he and neighbors would like the road paved. As the area has several new property owners, the town board asked that a new petition be presented. Dean Flygare agreed to obtain a new petition.
Dean Flygare expressed concerns with drainage on the new road and if the cul de sac is designed with adequate space for a school bus. John Dearing offered to make a site visit and check with State Department of Transportation regarding the water runoff and if turnaround is built to township specifications.
Other Business:
1. Corinna
Township Planning and Zoning:
A. October 8, 1007, Charles Marohn, Township Planner, sent a letter to Tom Salkowski, Wright County P7Z Administrator, stating that Township is aware County intends to retain legal services of John Baker; township is postponing assumption of local zoning administration until November 15, 2007; and township has also retained assistance of Peter Tiede with the hope that the 30-day postponement will give legal professionals time to identify any outstanding issues or areas of legal concern. Township intends to administer land use controls in a manner that is consistent with and at least as restrictive as Wright County. Final statement was that anything we can do together to further that objective would be welcomed by township officials.
B. Township Attorney Tim Young forwarded a copy of the actual presentation that Tom Salksowski gave to County Board Committee of the Whole, 10/2/07. Copy was forwarded by Tom Salkowski to Tim Young. Copy of the document was given to each town board member.
C. Township insurance includes coverage for Planning and Zoning.
D. Special Town Board Meeting, October 10, 2007 (posted on town bulletin board). Mpls Star and Tribune reporter requested to meet with town board to discuss Corinna Township plans to administer Planning and Zoning
E. Resolution 2007-03 covering adoption of Corinna Township Comprehensive Plan dated June, 2007; Ordinance 2007-01 covering regulating land use within boundaries of Corinna Township approved August 21, 2007 and Policy No. 07-01 for Policy on Intergovernmental Communication. Documents were signed.
F. Planning Commission Public Hearing, October 11, 2007, to discuss Subdivision Ordinance was not held and is rescheduled for Thursday, November 8, 2007 at 7 p.m. One of the townships official newspapers was not sent a legal notice to publish.
(1) 10/9/07, FAX from Tom Salkowski, Wright County Planning and Zoning Administrator stated that their office was not notified of this public hearing related to land use. Copy of FAX was given to each board memher.
(2) Community Growth Institute provided each board member a portfolio that included information: Five-Year Planning Cycle; Comprehensive Plan; Planning Maps; Plan Implementation; Ordinances; Zoning Map; Policies and Procedures and Internal Training.
2. Township Land and Cemetery at 108th Street. Board did not discuss the cemetery land encroachment onto private land as owner was unable to attend this meeting. Alan Jude stated that he would discuss land appraisal with township attorney.
3. Junk Violations: John Dearing made a site inspection of the two violators: Robert Balogh of 8611 Griffith Ave NW and Ron Worden of 9167 Kilbury Ave NW. As no attempt for clean up has been made, correspondence was forwarded to Sheriff’s Office for follow up and for possible legal action. Town Board commented on the difficulty of cleaning up a property when after the violation is reported for legal action, the property appears to in the process of some clean up and later property becomes a “junk area” again.
4. 103rd Street Road Reconstruction. Kjolhaug Environmental Services Company forwarded an as-built survey for the street project. Alan Jude will make follow up contacts with Kjolhaug and Otto and Associates.
5. Wright County Township Officer’s Association Meeting, 10/4/07. Two town board members attended. One of the featured speakers was Wayne Fingalson. Mr. Fingalson explained the federal aid project known as the Minnesota Pilot Sign Project which Wright County and Townships would have an agreement for a Town Road Sign Replacement Program. The Minnesota Department of Transportation using an independent consultant would evaluate the condition of township roadway signs and recommend removal, replacement and installation of certain of these signs. The township’s cost share of the project will be calculated by township miles of town road divided by the total number of miles of all town roads within the County multiplied by 20% of the cost of the project incurred within the County. Discussion. With motion by Dick Naaktgeboren and John Dearing second, the board approved entering into the sign project agreement with the Wright County Highway Department.
6. Legal Seminar, October 11 and 12 sponsored by Minnesota Association of Townships. No board member attended.
7. Metal Fabrication Warehouse in section 33 of Corinna Township. Scott Deckert of Wright County Planning and Zoning forwarded a copy of letter dated 9/21/07 sent to metal fabrication warehouse property owner that terms of Conditional Use Permit does not allow raw material to be stored outside along with a large amount of other outdoor storage. Failure to comply with terms of Conditional Use Permit will risk a revocation of the permit and/or legal action.
8, Elton and Gloria Schuette, 11341 Hollister Ave NW. (Telephone call 10/5/07) The Schuettes received a permit to build using footprint of cabin and to add a 14x20 garage. Request to proceed with legal description for a perpetual use easement that allows nearby property owner Peter Ramme family and succeeding property owners walking access on part of vacated land. Alan Jude offered to present this request to town attorney, Mr. Young.
9. Robert Dahl, 6829 Ingram Ave NW (continued from 10/2/07). Town board has made a site inspection and maintenance men have made a correction to the water runoff problem. Further action is needed.
10. Charlene Donnelly, Gardendale Center (continued from 10/2/07). John Dearing and Dick Naaktgeboren each made a site visit. The “No Parking” sign was in place, the paving did not cover cemetery area and in the discussion with Lake Center Bar and Grille owner, John Dearing offered “boulders” for one side of the cemetery that faces the parking area. Sheriff Gary Miller will have a “chat” with the two property owners.
11. Kathleen Braun, 9252 67th Street (10/8/07 telephone request). Request that town board consider the three commercial properties heavy use of road and pave the road. R. C. Carlson yard is a mess created by all the outside storage. Board noted that Wright County is following up on the outside storage problem and will discuss the road improvement at another meeting.
12. Barbara Scherek, 9182 Kilbury Ave NW, letter 10/3/07) Request for removal of sand, leaves and general debris from culvert that runs under her entrance road. Debris is closing off the culvert and allowing the water to back up into garage. Board noted that the catch basin should be cleaned and a copy of the letter was given to maintenance men.
13. Sandy Lake resident report (telephone call 10/3/07). Resident asked if gravel pit has been opened as several loads of sand/gravel have been hauled away. John Dearing responded that some digging has been done for the landowner’s own use.
14. Random Drug Testing: Maintenance Department: Drug screen results were negative.

With no further business to come before the board, Dick Naaktgeboren presented motion to adjourn. Motion was seconded by John Dearing and the meeting adjourned at 10:15 p.m.
