ORDINANCE NO: 1-2006

TOWNSHIP OF CORINNA

AN INTERIM ORDINANCE ESTABLISHING A MORITORIUM ON THE ESTABLISHMENT OR EXPANSION OF GRAVEL MINING OPERATIONS IN THE TOWNSHIP OF CORINNA AND ESTABLISHING A TIME FRAME FOR A PLANNING & ZONING STUDY TO BE CONDUCTED BY THE CORINNA TOWN BOARD AND CORINNA PLANNING TASK FORCE.

THE TOWN BOARD OF CORINNA TOWNSHIP HEREBY ORDAINS AS FOLLOWS:

WHEREAS the Town Board of Corinna Township, Minnesota has determined that a substantial concern and threat to health, safety and welfare of its citizenry exists based upon the impending potential negative impacts of gravel mining operations upon the surrounding neighborhoods based upon the effects of such operations which presently exist or are planned to be established and/or expanded; and

WHEREAS the Township is undertaking a study to develop a Comprehensive Plan through the establishment of a Planning Task Force which shall be responsible for conducting this study and working with the citizens of Corinna Township; and

WHEREAS the Planning Task Force has identified the issue of gravel mining to be of critical importance to the community and has identified Gravel Mining Operations in the Township as a Major Goal for study and analysis within the process of developing a Comprehensive Plan for Corinna Township; and

WHEREAS Wright County presently has authority through its Zoning Ordinance to regulate such uses in the County and heavily relies upon input from the local township in dealing with applications for Conditional Use Permits as the normal procedure for addressing these existing and proposed operations; and

WHEREAS the township will carefully review the Wright County Zoning Ordinance Regulations for Gravel Mining Operations and thoroughly analyze these regulations in the study to determine if enhancements to the standards, procedures and administrative handling of Gravel Mining Operations are appropriate to provide a more effective means of restricting and regulating such uses; and

WHEREAS Minnesota Statutes under the provisions of Section 462.355 provide the ability for the Town of Corinna to: "Adopt or amend a comprehensive plan; and establish an interim ordinance. The interim ordinance may regulate, restrict, or prohibit any use, development, or subdivision within the jurisdiction..." and;

WHEREAS an initial timeline and work plan has been formally approved by the Corinna Town Board which establishes a preliminary study period for the adoption of a Comprehensive Plan by Fall of 2006; and

WHEREAS one preliminary Goal Statement of the Comprehensive Plan, which reflects the broad input of members of the Town of Corinna during two community visioning. meetings and drafted in preliminary form by the Corinna Planning Task Force, states as a potential goal the need to: "Study & consider measures to create more effective controls for improved regulation of Gravel Mining Operations in Corinna Township."

NOW THEREFORE BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE TOWN OF CORINNA, MINNESOTA that an interim ordinance be established which hereby places a restriction on the creation or expansion of any new or existing Gravel Mining Operations, except for the minor expansion of an existing operation which is presently operating in a legal manner and in full compliance with all conditions of approval for its Conditional Use Permit issued by Wright County, and which do not expand, extend or intensify its present operations by more than ten (10%). The duration of this ordinance will remain in effect for twelve (12) months, from the effective date of this ordinance, or until such time that said ordinance shall be revoked, extended or otherwise amended.

BE IT FURTHER DECLARED THAT this interim ordinance is adopted pending completion and adoption of the Corinna Township Comprehensive Plan and any potential subsequent adoption of Official Land Use Controls that pertain specifically to permitting and regulation of Gravel Mining Operations within the Town of Corinna, Minnesota.

BE IT SO ORDERED that this ordinance is hereby adopted by Town of Corinna, Minnesota and shall become effective immediately upon its passage and publication as required by law.
